EPICA JIU JITSU ACADEMY RELEASE, LIABILITY WAIVER, AND INDEMNITY AGREEMENT

In consideration of being permitted to participate in any way in the programs, classes, and activities offered by EPICA JIU JITSU ACADEMY, I, the undersigned participant (or parent/legal guardian if participant is a minor), agree to the following terms:
1. Recognition of Inherent Risks
I acknowledge that participation in martial arts, combat sports, and fitness activities — including but not limited to Brazilian Jiu-Jitsu, Wrestling, Muay Thai, Boxing, self-defense training, and strength & conditioning — involves close physical contact, intense exertion, and unpredictable movement.
I understand that these activities carry inherent risks, including but not limited to sprains, strains, broken bones, concussions, joint injuries, paralysis, and even death. I voluntarily choose to participate, fully aware of these risks.
2. Health and Physical Condition
I certify that I am physically and mentally fit to participate safely in EPICA’s programs and have not been advised otherwise by a qualified medical professional.
I agree to disclose any medical conditions, injuries, or concerns that may affect my participation. I understand that failure to disclose such information releases EPICA from any related liability.
3. Assumption of Risk
I knowingly and voluntarily assume all risks — known and unknown — arising from my participation, including those caused by the negligence of EPICA JIU JITSU ACADEMY, its owners, instructors, employees, representatives, landlords, or other participants.
4. Use of Facilities and Equipment
I agree to use all EPICA equipment, mats, and facilities properly and safely, following all rules and instructions. I understand that any damage to equipment or property caused by my negligence may be my responsibility.
5. Release and Waiver of Liability
I hereby release, waive, and discharge EPICA JIU JITSU ACADEMY, its owners, employees, instructors, agents, affiliates, volunteers, independent contractors, landlords (including Boulevard Way LLC, Cranmer Associates Inc., and Deutscher Properties Corp), and all related entities from any and all claims, demands, losses, or causes of action arising out of my participation, whether caused by negligence or otherwise, to the fullest extent permitted by law.
6. Indemnification
I agree to indemnify and hold harmless EPICA and all related parties listed above from any and all liabilities, damages, or expenses (including reasonable attorney’s fees) resulting from my actions, negligence, or participation in any EPICA-related activity.
7. Photography and Media Release
I grant EPICA JIU JITSU ACADEMY permission to use photographs, videos, or other likenesses of me for promotional, educational, or marketing purposes without compensation or further approval. I waive any right to inspect or approve the materials.
8. Rules, Conduct, and Safety
I agree to follow all EPICA rules regarding safety, hygiene, behavior, and respect toward instructors and fellow participants. EPICA reserves the right to refuse service or remove any participant who fails to follow these guidelines, without refund.
9. Minor Participants
If the participant is under 18 years of age, I, as the parent or legal guardian, agree to this waiver on behalf of my child. I accept full responsibility for the participant’s conduct, safety, and participation.
10. Severability
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
11. Acknowledgment of Understanding
I have carefully read this document, understand its terms, and agree that I am signing it freely and voluntarily. I understand that this is a legally binding release of liability and assumption of risk agreement that will remain in effect for the duration of my participation at EPICA JIU JITSU ACADEMY.
